This website and the Esite platform are provided by Esite Online Services CC, registration number 2006/078051/23, a close corporation registered in South Africa (“Esite”, “we”, “us”). Contact us at hello@esite.co.za.

2. What this website is
esite.co.za is an information and marketing site about the Esite platform. Nothing on it is an offer capable of acceptance, a quotation, or advice on which you should act without confirmation from us in writing. Pricing, feature descriptions, service levels and availability may change, and are fixed only in a signed agreement.
This site does not sell goods to consumers and does not dispense medicine. Purchases of products, and the dispensing of prescriptions, happen on the storefront of the individual pharmacy concerned, under that pharmacy’s own terms.
3. The platform, and who contracts for it
Access to the Esite platform is provided to pharmacies and pharmacy groups under a separate written agreement, which sets out fees, service levels, the term and each party’s obligations. Where that agreement conflicts with these terms, the signed agreement prevails for the client bound by it.
Each pharmacy on the platform is an independent business. Esite supplies technology; the pharmacy remains solely responsible for its own retail and pharmaceutical practice, including compliance with the Pharmacy Act and the Medicines and Related Substances Act, the conduct of registered pharmacists, scheduled-medicine control, dispensing decisions, pricing and its contract with its customers.
4. Client data and integrations
- Your data stays yours. Catalogue, customer, order and prescription data belongs to the client. We process it as their operator and, on termination, export it to them.
- Source data governs output. The platform ingests Stock Master and Promo Master exports produced by Unisolv, ProPharm or a comparable system. We read those files faithfully; we do not warrant the accuracy, completeness or pricing correctness of the data they contain, and we cannot repair errors at their source. The client decides which products publish.
- Third-party systems. Unisolv, ProPharm, Paystack, Sage, Xero, Google, Meta, Apple and Google Play are independent third parties. We are not responsible for their availability, changes to their formats or interfaces, their fees, or decisions they make about a client’s account.
- Content is the client’s. Product descriptions, imagery, brand assets, page copy, store policies and marketing are supplied by the client, who warrants it has the right to use them. AI-drafted copy is a suggestion for review, and nothing publishes without the client’s approval.
5. Payments, payouts and refunds
Storefront payments are processed by Paystack. On a successful payment the proceeds are split automatically: 99% to the pharmacy’s own Paystack subaccount and 1% to Esite as platform commission. Paystack’s own processing fees apply separately and are charged by Paystack.
Refunds are initiated by the pharmacy and recovered proportionally across the same split. Because settlement is periodic, a refund is funded from the pharmacy’s pending settlement balance. The pharmacy remains responsible for its own refund, return and cancellation policy towards its customers, including any rights under the Consumer Protection Act.
6. Acceptable use
You may not, and may not permit anyone to:
- Attempt to gain unauthorised access to the platform, another tenant's data, or any account that is not yours.
- Probe, scan, load-test or interfere with the service or its infrastructure without our written permission.
- Scrape, resell or systematically extract content, catalogue data or pricing from this site or any storefront.
- Upload malware, unlawful material, or personal information you have no lawful basis to share.
- Use the platform to market or supply scheduled medicines other than as South African law permits.
We may suspend access where use of the service threatens its security, its stability or the data of others, and will restore it as soon as the cause is resolved.
7. Intellectual property
The Esite platform, its source code, design, documentation, name and logo remain the property of Esite Online Services CC. A client receives a non-exclusive, non-transferable right to use the platform for the term of its agreement, and no rights in the underlying software. Client trade marks, brand assets and content remain the client’s property, licensed to us only so far as we need it to run and support their storefront.
Third-party names on this site, including the names of pharmacy groups and of Unisolv and ProPharm, are the property of their owners and appear for identification only.
8. Availability
We aim to keep the platform available at all times, and contracted uptime commitments and service credits, where they apply, are set out in the client’s agreement. This marketing website is provided as-is, without an availability commitment. Planned maintenance is notified in advance where it could be disruptive.
9. Liability
To the fullest extent the law allows, Esite is not liable for indirect or consequential loss, loss of profit, loss of goodwill, or loss or corruption of data arising from data supplied to us or from a third-party service. Where liability cannot be excluded, it is limited to the fees paid by the client to Esite in the three months preceding the event giving rise to the claim.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.
10. Privacy
Our handling of personal information, and the division of POPIA responsibility between Esite as operator and each pharmacy as responsible party, is described in our Privacy Policy, which forms part of these terms.
11. Changes, law and disputes
We may amend these terms from time to time; the current version is always published at esite.co.za/terms with its effective date. Material changes affecting a client under a signed agreement are handled through that agreement.
These terms are governed by the law of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts. We ask that you raise any dispute with us directly first, at hello@esite.co.za, so we can try to resolve it.
